This person has an IQ of 48.

He is lucky if he can find his way to the bathroom alone.

He legally does not have the capacity to give informed consent.

Several states in the U.S. restrict sexual contact if one party is intoxicated or if one party is mentally challenged.

The ability to make an informed decision is the key to the context or the court decision, and a valid one.

When I was in the Army I rose to a rank that I was giving orders and responsible for them to be carried out. An older NCO told me that a leader should not issue orders that he knows will not be obeyed. I don't see how this order can be enforced with out a full time keeper for Alan.

In Britain, the Court of Protection can make decisions for people deemed to lack the intelligence to make them themselves. These people can be ordered to undergo surgery, have ********s, be forced to use contraception — even have life support switched off.
Sounds like what they want for all of us.....

I personally believe that people with very low intelligence should be sterilized and not allowed to vote.
The gene pool needs a serious bleaching. Unfortunately, it will probably never happen because stupid people have already taken over the world.

I concur fully, and women should be made to hide their pretty faces with a burqa, (blatant flaming west coast sarcasm)

If a person is not mentally capable of understanding social situations and is not capable of making informed decisions, then the chances are they are being used by someone else. The law is set up to protect against that. The people in that society decide upon what the criteria will be, and the judicial system enforces that decision.

Bit puzzled here.

I can understand the reasoning behind not allowing those extensively mentally handicapped or genetically afflicted with hereditary diseases from being able to have children. They can't keep them up on their own, and in many cases may be able to pass on the traits.

But court ordering a mentally handicapped homosexual from having sex?
How exactly do you enforce that ruling?

I can understand the why's, allegedly the person is overtly lewd and provocative.
The how's of the whole thing are what I fail to get.

I am more concerned with who exactly is his, eh boyfriend.
I'll just take the stand of it, why would a normal minded person want to engage with the person, beyond physical lewdness?
He's Handicapped for Pete's sakes.

This "Kieron" is a creep if he's normal, who is taking advantage of a mentally disabled person. He could be the whole reason that things got to the point where they did.

I'm fine with the concept.Help protect the mentally handicapped (AKA as retards). Just don't know how you enforce it. I think convicted sexual predators should be castrated. Why not? Make it like a three strikes law. Maybe they could sell the parts to the local chinese restaurant and raise money for a Pelosi labotomy.... wait, she's had one.

I believe my only concern would be if this man is a victim of sexual abuse by someone taking advantage of him. If that was the case it would make more since to forbid the abuser from having contact. They do that by getting a conservator to get a restraining order against the partner. For a heterosexual the court may need to get the low IQ man or woman sterilized because they would not be able to raise a child.

As far as sterilizing people because of genetic disorders, just remember anything under 5'11" is too short to reproduce. (We're down to 10% now).

That whole article sounds like the guy is a lifelong Democrat of some sort. Right down to making lewd gestures at children. This has got to be real because you couldn't make up something like this article. A socialist state denying a socialist Democrat the right to have sex??? Gee, and the Democrats wonder why Americans are revolting against a socialist regime here...

I think there is more to this....am wondering if hidden behind privacy rules are actual incidents, or even near misses of a sexual nature with kids. Or adults, for that matter.
I personally know a few intellectually disabled folks (both teens and adults) that I would NOT let my kids near just because of a clear risk of such a thing happening.
But I also will say, my kids also spend a fair bit of time with intellectually disabled folks who are some of the nicest and most innocent folks in the world, and that I trust implicitly.

As to implementation; maybe he would have to reside in a group home under supervision- or at worst, some form of medication.

I think that it is hard to pass judegement without knowing the whole situation. I also think that if the guy is mentally incompetant to the point that he cannot give consent, he is being taken advantage of and his lover should be prosecuted.

Denying someone the right to have sex (unless hurting others or kids) is like denying someone the right to eat and breath. Sex is the most basic thing someone can do with another person.

Sooner or later you will be too dumb to drive a car, own a gun, buy a house, purchase healthcare, vote, or live without any other government help.

I think anyone who is of sound mind should be prosecuted for having sex with someone unable to consent.

I do not think the person unable to consent should be forced to be sterilized or otherwise punished. If they want to spend all day in their room playing with their junk, that doesn't hurt anybody either.

I would not force a retarded person to terminate her pregnancy but I would try her partner for rape.

Being sterilized does not prevent one from having sex, it simply removes the possibility of sperm being involved with anything. (i'm trying to tread lightly with my wording)
