Vague statements issued re killing of pastor by Oklahoma state troopers

The troopers responded to a report of a stranded vehicle in Okmulgee County, about 20 miles south of Tulsa, about 9:30 p.m. Friday. They found two men trying to remove a vehicle from a roadway over which water was rising and moving quickly, according to Capt. Paul Timmons.

“They were trying to get them to come out of the water. They were worried about them getting swept away,” Timmons said. “(The men), for whatever reason, were just really upset about having to leave the vehicle there.”

At least one man attacked a trooper after reaching dry land and was shot and killed. It wasn’t immediately known how many shots were fired or whether one or both troopers shot.

“It’s not real clear how it all transpired,” according to Timmons.

Timmons said the shooting occurred in the area of Hectorville Road and Bixby Road, and that authorities had received a report of a stranded vehicle on Bixby Road around 9:20 p.m. Friday. Troopers arrived to find Nehemiah and Brandon Fischer, who appeared to be pushing a vehicle that had stalled due to flooding, Timmons said.

“The water was already fairly deep, and it was starting to rise pretty quickly and it was running pretty rapidly across the road,” he said. “They were concerned these guys would be swept away.”

A trooper on the scene told the brothers to get to higher ground, and a physical confrontation occurred soon after, Timmons said.

“For whatever reason, and this is where it gets a little cloudy, (the men) approached the troopers,” he said. “Shots were fired.”

Timmons said a weapon was recovered from one of the suspects, but it wasn’t immediately known which man had the weapon or whether shots were fired at the troopers, the Associated Press reported.

It wasn’t clear Saturday whether one or both troopers at the scene fired at the men, but Nehemiah Fischer was struck and died at the scene. Timmons said Brandon Fischer was uninjured.

Authorities did not describe what kind of altercation may have occurred between them and the troopers.

According to police, the officers told Fischer and his older brother, Brandon, to leave their stalled car and move to higher ground. Some kind of confrontation ensued and Nehemiah Fischer was killed. Brandon Fischer was not hurt. He was arrested on suspicion of assault.

Fischer had a gun, said captain Paul Timmons, an Oklahoma department of public safety spokesman. He said he was unable to provide more detail about whether Fischer was armed at the moment of the shooting and who exactly fired the shots.

“A handgun was found,” he told the Guardian. “I can’t verify whether it was being brandished but the deceased individual did have a handgun … the investigators are still trying to determine how many shots were fired. We know there was more than one but an exact number, I don’t have that information available yet.”

Fischer was an associate pastor at Faith Bible Church in Tulsa. I listened to parts of his sermons. Seems like he was a humble, level-headed Bible teacher.

I live outside Tulsa and the local news outlets do not or are not carrying anything other than what Timmons has said. I do know the area where it happened and with all of the rain recently, would not be surprised about the flash flood. Happened to me on the way home yesterday.
Too early for the dash cams and with state law regarding the Troopers cams, would not surprise me that the video never hits the news.

Don't you love how they bring up the fact that he had a gun as circumstantial evidence of his guilt in an "altercation" which seems questionable in this case.

I'm just a walking guilty man waiting for something to happen nearby so I can be implicated, I guess.

This isn't the first time police have been called to help or save someone, and end up fatally shooting them instead.
Yeah, since you called 911, you should get a free "kill or hurt the cop card". If you act now, you will also receive a free "get out of jail" card.

I'm sorry that real life doesn't coincide with your imaginary utopia.

Wont be long before we read:

"and the suspect was shot 87 times by the lone officer for not obeying verbal commands and looking at him in a disrespectful manner. It was later determined that the suspect was a blind, deaf mute. The suspects brother was arrested for maybe thinking about one day trying to decide whether or not to maybe resist arrest."

Which is an excellent reason to execute him! /sarc

That logic aside, if the guy was holding his head underwater - and that can be shown to be true - then that was a life threatening situation and his partner had to act. In such a case I say this is justified. I like cops less than most but right is right.

Funny how this story started out being 2 brothers, one a pastor, trapped on a car in rushing water and the police shoots and kills one, with seemingly no reason. Now we have 2 drunk brothers, one a pastor, carrying a weapon, messing around shooting snakes in the dark in rushing water, by a roadway. The drunk "pastor" attacks police officer, holding his head under water, and gets shot. I think the partner did the right thing, he had another drunk to deal with too. And Btw, you can't tase someone in the water!

At what point does law enforcement have the right to tell the brothers to abandon their car? Its their property to protect, if they want to play in the water they should be free to do so . If some kind of forced evacuation ever comes down around here I too may have a problem with authority figures poking around my place. I'm not defending attacking a LEO but lets remember it takes two to tango.

Because if the two brothers got caught up and washed away then the troopers have a duty to act. The two brothers getting washed away would place all the rescuers that had to be brought in to R/R their drunk asses in danger.

The pickup was blocking traffic. And the brothers were standing in the middle of a thoroughfare. The brothers were public drunk.

If they had been ****faced at the house this wouldn't have happened.

Good thing they stopped them from getting wet, "for their own safety", I'm still not buying it. I don't see any blue lights blinking off the stop sign, all I see is two guys being talked to like dogs with spotlights in their face, I cant really blame them for coming up mad. I can however hold them accountable for their actions because shoving someone, anyone , is not how a civilized person handles their emotions. I'm just stating that this situation should have not been escalated to this point at all and wouldn't have been if the officer had used a more polite tone instead of just repeating over and over like he was calling a puppy that had peed on the carpet.

This touches a nerve with me as a WhiteWater boater, just because the officers don't feel comfortable around rushing water , does that mean I have to be "saved" from it? I reserve the right to die in any adrenaline filled way I choose, and I accept those calculated risks on every run. I thought that was the freedom we all fought for. The freedom to be your own man living as you see best.

I'm betting that you don't whitewater in a public road ...and I hope you don't intoxicated, though you do have a right to. The public road is the issue.

Don't push me like that either, you could end up with lead poisoning. I just don't see what these brothers were doing as dangerous to public safety. Traffic is still moving. I wasn't there and thirty four seconds of video doesn't do it for me that's all. But charging up to anyone like that is the opener to a butt whuppin where I'm from. But I can also see why the brothers were irritated.
