Someone stealing your potted plant: Would you shoot?

In light of the other thread regarding the old man shooting someone stealing a potted plant from his yard, would you shoot to kill?

but that is only if they don't get the hint first time

had an incident with some city guys who were inspecting a pipeline near my house (takes water to the nearby city from the river)

but i was outside and say in the distance someone pick a pear and take a bite now one pear I'm upset about but i can let slide then this city boy starts loading up a frigen bag with my pears while his friends are each eating one

so I went inside got my rifle and took aim and shot a pear right in front of his face wich exploded spectacularly and they all got in there truck real fast and left

left the bag of pears too and i have never seen them again well city boys yes bot not those city boys and no ones crossed onto my property either

if they had not gotten the idea with the first shot i would have sent the next one through him

I would not though go straight to kill i would give them a hint first

I would not for the following reasons:

1. The S hasn't HTF yet.

2. Even with Castle Doctrine and that "Stand your Ground" in my state, I would still have to answer a bunch of questions, be investigated, have to pay a lawyer, and mes around in court for 5 years.

3. Even if the SHTF, I wouldn't because you can't eat my potted plants, so they would be worthless. If they were stealing my crops... and the situation was bad enough, I would consider shooting.

i would't kill over a plant but unless I KNEW that the plant is what they were after I would problaly think they were there for other reasons.....to rob the residence or break in. Being daylight I wouldn't be as quick to feel 'fear' as I would at night (with the obvious disadvantage of the dark). Seeing as how I have a black thumb the plant would probably fare better. As I dont' live in the city or have strangers around I'm not sure how I would react, but would protect my home.

Perhaps you are suggesting that the item was too small in value to warrent the response ??

perhaps we need a new Obama regulation with a minimum value to kill a thief ??

$25 shoot in the leg, $100 = abdomin, $1000 = head shot ??

if I am broke stealing a 10 dollar item from me is a lot

if I am Mitt Romney do you think that say a thief stealing only 10 thousand dollar item should be let go ?? as it is also a drop in the bucket ??

Here is MY regulation...

a thief is a thief, and a bullet is a bullet....they go together well !!

Hell no, There is a time and place for everything. Depends on the situation. But for the most part hell no.

"Trigger Happy" people give me the creeps. And before people get their panties in a bunch over that statement I would like to add....
Most trigger happy people are not fun around to anyways, so no loss.

you live in cali what do you know of trigger happy? what trigger happy to you is probably normal for the rest of america.

I'm plenty of fun to be around just don't be stupid around me because you will win a stupid prize if you do

My land is posted clearly with no trespass warnings, once you cross the property line you have committed a criminal act and opened yourself up to the repercussions, it takes 45min to 1 hr for 911 to respond to this area, 1911 takes less than 2 seconds.

Stealing is stealing, doesn't matter what it is, I wouldn't shoot at kids but adults are fair game after I turn the dogs loose. ;)

For all our friends in other countries who get many of their opinions about us gun carriers from the press or the movies:

If I were inside the house, shirt off and oiled up, with my bandana around my head and observed someone approaching who I thought was going to take one of my plants, I would make safe my fully automatic M16, unstrap the MP5, and lay my 16" bowie knife to the side as well.

I would throw on my white shirt, white cowboy hat, and strap my holster on containing two Colt 45 single action revolvers. I would go onto the porch and tell that bandit to drop my pot. If he didn't comply, I would do a quick draw, and shooting from the hip from 50 yards, graze his wrist forcing him to drop the plant. I assume he would then thank me for the mercy I showed, and walk down to Doc's office to get himself patched up.

That's how we do it here in America :)

honestly tho there are a lot of folks who are idiots with firearms.

if I was not as good a shot as I was I would not dare to intentionally have a near miss but I practice a lot as I shoot competitively

I wouldnt have shot, but I would have confronted him with the pistol leveled at his gut. We dont know the old guys frame of mind. Maybe he has been a victim one too many times and he just said "no more". However, even though I wouldnt have pulled the trigger (unless he ignored me or made an agressive move), I cant fault the old guy and I'll bet he doesnt get into any trouble. The castle doctrine here in Texas makes no distinction as to property value as far as I am aware. So the simplest thing to do is, dont steal!

I'm not sure I could really say, my warning shot'd prolly come from my beebee gun though, lol. And, unless I'm defending my life or someone else's I don't see a reason to kill, I think a bullet to the leg would get the message across. But as a Christian, I can't justify killing even to protect myself, but I know I would. I'm not strong enough to give in, if that makes any sense. submission to the Lord's will takes a lot of heart and sacrifice and I'm sorry to say I'd fight to stay alive to protect my family.

Except, for a lot of people it is kind of about whether it is worth the trouble. If you shoot someone you potentially face civil and criminal charges. Will you be convicted or lose the civil suit? Doubtful, but you still have to go through a long drawn out legal process. I support the homeowner being able to defend himself. I even support him being able to defend his property. However, if a person chooses to exercise their rights to do those things, they must also be fully prepared for any legal troubles that come their way. Personally, I am not getting into a legal battle, nor am I having the blood of another human being on my hands over a plant, or a car for that matter.

So, while I do not condemn this man for what he has done, it just does not make sense for me, and I'd venture to guess a lot of people to do the same thing.

We already discussed this in the other topic.

The purpose of castle law is not to prevent property from getting stolen. It is about protecting the sanctity of your home.

Goods are not worth killing people over. However when people forcibly or illegally enter your home, you do have the right to defend your home. That was the real root of the matter, not some $5 pottery.

A person is justified in using deadly force against another to protect land or tangible, movable property: (1) if he would be justified in using force against the other under Section 9.41; and(2) when and to the degree he reasonably believes the deadly force is immediately necessary: (A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and(3) he reasonably believes that: (A) the land or property cannot be protected or recovered by any other means; or(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

What is all this Monday-morning quarterbacking? I don't know WTF happened with
the potted plant thief (Or how potted he was). I mean, OK - I hear a noise downstairs
and I grab some iron and sneak down there and here's an Obama-voter with a potted
plant in his hands - is that it? I'd focus on his hands and tell him not to drop the plant
or I'd kill him, and if he dropped the plant I'd kill him. It's got nothing to do with
the plant! and I'm completely wired on adrenalin and somebody's in my house.
All y'all's trying to second guess somebody in a situation like that? Get a clue...
If he even HAD the plant and I even had time to think about it I"d figure he was out
of his mind on PCP or something. For pete's sake!! (And who's Pete, btw?)
