Shopowner arrested after helping woman

Area has had big bump in crime, shop owner charged with felony assault with a firearm. Odd he can be charged since robber got away and is not around anymore. And shop owner has to come up with bail, why not own recognizance since he has business and not likely to flee. Since he has a liquor store licenses come into play too.

because armed citizens (subjects) does not fit the narative
"We don't want people( my bold) to fire weapons into our community. There could be unintended victims," Chief LeRonne Armstrong said.
The chief's message was that Oakland should come together as a community and citizens should not put one another in harm's way " " (impliying goverment agents are perfectly fine endaangering citizens)

Oakland was a hellhole when I left the Bay Area 20 years ago. I doubt it has improved.

I feel bad for the owner, though.

I think the crux of what the outcome will be is written in the news story: "The Alameda County District Attorney's office will review the case. There is no timeline available on when the possible charges will be filed" They are going to review the case and drop it like a hot potato. I'm relatively sure it went down something like this poor guy gets pinched right after the incident. Calls get made and some field Lt. briefs the Chief the next morning.

Chief says to file charges. Some detective has to write the case and get it to the D.A. within 72 hours (More if a weekend or holiday) because the guy is in custody. Meanwhile the guy posts bond and is out so the clock for the detective is now off, he can sit on it until the statute of limitations comes into play or until his boss starts getting into his ear about it.

Once filed, the DA would be stupid to try and go forward with the case. At best it will get kicked to the City Attorney and refiled as a misdemeanor. Now the City Attorney will probably drop it too. If they don't the trial won't last long and he will be acquitted. California may be a lot of things wrong but you can still defend yourself and other against a violent attack with a firearm. That shop owner can legally carry a concealed firearm in his store without a permit. Once he comes outside of the shop things get a little sticky for him. Even with that great levy will be attached to what he was trying to do. This is a mess though no two ways about it. He should be receiving an accommodation from that chief instead he's now suffering that fool for the time being.

Unfortunately that is how these sort of things work. Firing a gun off within a city in extremely serious because of the high risk of hitting people by accident. Which is why if you fire a gun within a city, you are almost always going to be investigated. Even if you are innocent, they still need to look into it.

Without knowing all the facts I can see scenarios where the chief might have had a point depending on the totality of the circumstances. But reading other quotes in other more recent articles it sounds like he sending a message to the community “don’t exercise your 2nd amendment rights“. I say this because the chief said.

This is a shame. He doesn’t want potential victims to be able to defend themselves from criminals. He does not want criminals to have any deterrent to do what they want. In a high crime area he is catering to criminals. He only became police chief about two weeks ago in an area that has gone through many chiefs in the last 18 years. For the sake up the non criminals in his area, I hope he does not last the year.

This is a shame. He doesn’t want potential victims to be able to defend themselves from criminals. He does not want criminals to have any deterrent to do what they want. The lesson of this not to fire warning shots but to stop the perp from doing doing what he or she is doing and should they make you in fear for your life and or great bodily then you shoot them ! and NOT the air ! And you shoot to kill or you may have to support them for the remainder of there miserable lives.

I wonder if Chiefy here has ever tried calling the OPD for something to gauge what the response is like. ****ing laughable.

Sometimes its not worth getting involved in a situation. It's one thing if there's a mass shooting and you have the power to stop the threat and save lives. Of course you have to get involved. But if it's just a matter of stopping some punk from robbing a store, you might want to sit it out if you are in a jurisdiction that is just as likely to prosecute you as they are the punk robbing the joint.
