Eagle Scout Suspended for Survival Kit Locked in Car

A 17-year-old Eagle Scout in upstate New York has been barred from stepping foot on school grounds for 20 days — for keeping a 2-inch pocketknife locked in a survival kit in his car.

Matthew Whalen, a senior at Lansingburgh Senior High School, says he follows the Boy Scout motto and is always prepared, stocking his car with a sleeping bag, water, a ready-to-eat meal — and the knife, which was given to him by his grandfather, a police chief in a nearby town.

But Lansingburgh High has a zero-tolerance policy, and when school officials discovered that Whalen kept his knife locked in his car, he says, they suspended him for five days — and then tacked on an additional 15 after a hearing.......more at link
In an interview with Foxnews.com, Whalen recalled the incident that led to his suspension.

He said his school's assistant principal, Frank Macri, approached him on Sept. 21 and asked him if he was carrying a knife.

"I was taken down to the office, and they told me that a student told them that I was carrying a knife," Whalen said.

He said he told them "they could search me and everything, and they said, 'There's no need for that.'"

Whalen said he doesn't know who might have said he was carrying a knife, but he was open with school officials.

"And they said, 'Do you own a knife?' I said, 'Yes, I'm a soldier and an Eagle Scout — I own a knife.'

"And they were like, 'Well, is it in your car or anything?' And I told them, 'Yeah, it's in my car right now.'

"And they asked me to show it to them. I didn't realize it was going to be a problem. I knew it wasn't illegal — my police chief grandfather gave the knife to me."

Whalen said he took school administrators to his car because he thought their fears would be allayed when they saw it was just a 2-inch knife.

"They thought I had a dagger in my car or something like that, so I thought yeah, I'd show it to them," Whalen said.

"I showed it to them, and they told me I had a knife on school property and had to be suspended."

But things didn't end there, Whalen said.

"They brought a cop in, who told them 'he's not breaking any laws, so I can't charge him with anything.'

Whalen said he asked Macri why a 2-inch pocketknife would be considered more dangerous than other everyday items around the school.

"I said to him, 'What about a person who has a bat, on a baseball team? That could be a weapon.' And he said, 'Well, it's not the same thing.'"

The school district's policy lists "Possessing a weapon" under "examples of violent conduct," which "may be subject to disciplinary action, up to and including suspension from school."

School district officials did not reply to requests for comment.

Whalen says Macri gave him the longest suspension possible — five school days.

"They gave me the five-day suspension, because that is all a principal can suspend a student for," he said. "And from there, they had a superintendent hearing to see if the superintendent wanted to suspend me for longer.

"But the superintendent wasn't even at the hearing. It was the principal and the athletic director. The vice principal who originally suspended me wasn't even there, and neither was the superintendent. They basically asked me, 'Did you have the knife in your car?' And I said 'Yes, I did.' The meeting was recorded and they told me they were going to play the tape to the superintendent.

"They asked me if I wanted to say anything, and I told them all my accomplishments and what I've done, and the principal even admitted that I had no intent to use the knife, that I had no accessibility to the knife."

But school officials decided to suspend Whalen for an extra 15 days anyway, he said. And unless the decision is changed, he will not be allowed on school grounds until Oct. 21.

Whalen said he does not know why the 15 days were added, but he said a school district employee told him it was because the school wanted to apply its policies consistently.

"I've been told by someone who works for the district that they had to do it, because if someone else had a knife and they saw that I didn't get a suspension, that it would look bad for the school."

School superintendent George Goodwin and Lansingburg Senior High School Principal Angelina Bergin did not return calls for comment Tuesday morning.

probably a random (or with dogs) contraband search. Had to run some of those before, but then we already knew the usual suspects and they ALWAYS had crap- usually weed, coke, or prescription meds. When I found someone with a blade on them, If it was aq student I knew to be okay- I gave it back to them and told them to hide it. (this school was in a bad side of town).

If the blade belonged to a thug or wannabe- Down he went.

The sad thing is what it could do to his plans for the military and West Point - things have gone just way too far and it keeps piling up daily.

I know a guy who called in a bomb threat at his high school. Labeled a "terrorist threat". I believe he was expelled and put on house arrest for the offense. When he decided to join the Marines years later, the issue came up. But the recruiter or whoever talked to the school and learned that this was just a stupid mistake from an otherwise good kid. He got into the Marines anyway and will most likely deploy to Afghanistan this October. Hopefully, the same will be true for this kid.

I encourage my kids to always tell the truth--no matter what. Tell the truth and let justice be done based on the facts, reason and good judgement.

This kind of malarkey just encourages good kids like this eagle scout to become deceitful and recluctant to share with those who are supposed to be excercising good judgement.

IMO the school district has done their community and injustice. All kids in that district just got taught that it is better to lie and save your ass rather than be truthful and trust the faculty.

I saw him interviewed today and thought that someone must have had it out for him or the family. I think he said his dad or grandad was a retired police chief and he had already gone thru basic training. Maybe there was bad blood in town or something. He shouldnt have his life/career ruined over it. Stupid.

Why didn't he just leave the damn knife at home and put a folding saw in his kit. It's pretty much impressed on everyone that no weapons on school property means no weapons. Zero tolerance means zero tolerance, not I'm an eagle scout and the rule shouldn't apply to me because I'm special. Don't know why they called the cops though usually the kid just gets a week off from school or expelled for the year if it's a second offense. Don't know why folks on this board still throw a hissey fit over this BS zero tolerance rules have been around since the 90's.

Well, the "it's been going on for X amount of years" attitude is what allows that type of across the board "Big Brother" mentality.

And the baseball bat is "different" mahlarkey is just an Administrator with an agenda. When the hell is this kind of craziness, with the sweeping regulations that no longer allows a person to be judged on merit and basic moral fiber going to stop?

We can't protect everyone. Life at times sucks, wear a helmet.....:rolleyes:

I guess the days or having a shotgun in your vehicle in the parking lot AT SCHOOL during deer season when I was raised in Western NY are a waaaaay long ago thing of the past...funny, no one ever was murdered or shot...;)

cranky1950 you might think about cutting back on the caffine a litle bit. if he were my son and was an eagle scout, bet your old grumpy ass he would still have the monster size 2" blade still in his car. if he were a punk, it would be differant. thats just my opinion.

park off schools grounds... simple as that... do you have knife yes I do.. is it on you no its not.. were is it in my car weres your car parked on the street.. next to the school they were like o... its not on school grounds ok your free to go.. Ive been robed in school at knife point I beat the crap out of the 2 people that tried to rob me a teacher saw it and was like what happend I told them they tried to rob me at knife point and I fought back.. 1 they had it folded and stuck it in my back and said I have a knife dont turn around ... it was round so I was like O its just a stick turn around and start swinging.. didnt like when they pushed me into the wall.. after that I started carrying the knife on me at school and I was asked why I carry it I simply say Im part scotish.. its religion they like ok... carry on.. which isnt a lie.. Im part scottish that and the pricnpal lived beside my grandmother so I saw her every single summer and she knew my grandfather gave me a knife at the age of 5.. because I would play in the bush

That's so ASS-BACKWARD. Completely contrary to the intent of zero tolerance regs.

Because the Eagle Scout was right: The principal used his own personal interpretation to decide that a bat is not a dangerous weapon, and a 2-inch pocket knife locked in a car is... when in fact the bat is far more dangerous than the pocket knife. The principal clearly could have used discretion in this matter, and interpreted the knife as a "tool" rather than a dangerous weapon. Or, alternatively, he could have informed the Eagle Scout of the no tolerance policy without asking him if he had it in his car, but making it clear to him that he could not have such a thing in his car. Kid probably wouldn't have brought it the next day. No, they were clearly out to burn this kid.

I wonder if I should remove the shovel I put in my nieces car. She's in school and I can lop heads off. Rules are rules dontchaknow.


To those who approve or dismiss..... let your chains rest lightly. When even ONE of you get busted because the batteries in that maglight in your car were dead making it functional only as weapon I'm wanna come laugh in your smarmy faces when you go down.

what a crock of S*** :mad: :mad: :mad: My highschool (KS) doesnt allow firearms in vehicles after 9/11 but everything else is pretty much fair game. Knives, ammo, magazines, clips. whatever meets your fancy. We have a Police officer stationed full time at school and he always asks to borrow my latest edition of Soldier of Fortune Magazine. I can understand being a little more strict in NY but a 5-day suspension + 15 for a bloody pocket knife. What is the world coming to. :confused:

I guess I dont really view a knife as weapon, but a tool that could be used as a weapon. Just like a bat, golf club, hammer, tire iron, ect. hell even the vehicle he had it in is a tool which could be used as a weapon (could inflict a lot more damage then a 2 inch knife). I always carry a knife and never once used it as a weapon, but use it all the time as a tool.

I think in a case like this it should be taken into consideration the intent in which the tool (or weapon) was to be used (he was a boyscout for crying out loud).

A little common sense goes a long, long way.

He was not carrying it into the school , had no ill intentions, was not a gangster using it for protection, ect. He was only a boyscout being prepared.

Even police can use discretion in their jobs, I believe they should use discretion when implementing these rules.

Lets leave the kid alone.

Anyways, while I understand the zero tolerance, this is no different then places that have "No Gun" signs to keep the LEGAL concealed carry people out.

Those who have the intention won't be stopped by the stupid rule.

Also, better fire every one who works in the schools shipping area. Also the person in control of the supply room. There be box knives in there. Zero Tolerance after all.

In response to the "park off school grounds". Funny thing about that, if the kid is in school, anything between the school and the kids home is considered "school grounds". I got suspended in high school for defending myself when I got jumped 6 blocks from school. So did they, but the school has a Zero Tolerance to violence of any form. (This was in the early 90s)

But had he had a pair of scissors that come apart as 2 knives he would be ok.... this kid basically had a GHB.BOB in his car and being fried for it. Could happen to any one of us... I remember as a kid, not too long ago when you parked your car just outside of the school zone, to us it was a church parking lot so you could keep you shotgun in your truck after hunting in the morning.
