Caught someone....

trying to get into my house last night..... I had been out and came home to find the floodlight bulbs unscrewed by my back door.........

So we went into the house like nothing had happened and then I came back out through the walkout basement door. Wife shut off the interior lights like we were going to bed and was waiting with her shotgun. I sat in the airtrap (my interior door has an area about 5 feet deep before you go outside from the basement) for about 45 minutes before I heard someone coming. I just sat and listened until I heard this person trying to force the door. I came out of the entryway and walked about 10 steps and turned on the flashlight and when he screamed like a little ***** hit him as hard as I could with my baseball bat.

When he screamed the wife called 911 and reported an attempted break in. Local PD took about 10 minutes to show up and when they did they asked me how he got such a bruise on his jaw - so I showed them the baseball bat. The Sgt had no problem with my methods and they took him into custody for attempted B&E in the nighttime, Trespassing, and possession of narcotics.

Can't wait for the court case

Peoples Republic of Massachusetts' version of a Castle Law:

MGL c.278, s.8A
"In the prosecution of a person who is an occupant of a dwelling charged with killing or injuring one who was unlawfully in said dwelling, it shall be a defense that the occupant was in his dwelling at the time of the offense and that he acted in the reasonable belief that the person unlawfully in said dwelling was about to inflict great bodily injury or death upon said occupant or upon another person lawfully in said dwelling, and that said occupant used reasonable means to defend himself or such other person lawfully in said dwelling. There shall be no duty on said occupant to retreat from such person unlawfully in said dwelling."

Glad things worked out well for you. Personally, I would have confronted the home invader with a buckshot-loaded shotgun or .45 auto, and LED flashlight.

I hope the SOB's jaw is broke and needs to be wired shut!
No, wait.. The homeowner will get sued for excessive use of force LoL :rolleyes:

He can sue all he wants. Chances are he wont. And if he does, the jury aint going to buy it. Especially if one of them has been the victim of a crime their self, which is very likely today.

My house has been upgraded with motion lights that dont take screw-in bulbs. There's no way to disable them quietly without smashing them to bits.

That really sucks. If your able to react quickly enough, when someone swings a bat at you step right to to them as if you're going to chest bump them. The bat will swing outside of your area. Then you immediately place one leg behind them and push them backwards tripping them. As they go down they will most likely let go of the bat. You can recover the bat and now you are in control. It takes a little practice but preparation is what WE ARE ALL ABOUT, right?

It's not easy to keep your wits about when something like this is taking place. Although I am not glad this happened to you in particular, I am glad that you were able to handle it and come out ahead.

Which also means that if the perp did this to someone else, the score may have been reversed in the bg's favor. Your neighbors owe you some gratitude.

Also, a big high five to the wifey. Anyone who wields a shotgun with poise in times of stress is to be commended.

Nowadays, don't say anything to the cops without your lawyer present, especially when force was used. It doesn't matter if you were arrested or not, anything you say can and probably will be used against you if it goes to court. We have the right to remain silent and cases like this we should. It amazes me how this could turn into the bad guys favor because of a few wrong words.

My personal opinion is great job.:thumb:

I hope you hit him hard enough to Knock some sense into him, to not Break into houses.
Of course with al those charges he got, you would probally get tired of hitting him before you knocked any sense into him..Great Job though ...Congradulations.

Good on you ! It's a good thing that perp was in the Democratic Peoples Republic of Massachusetts instead of Texas! Well done! Very well done! I especially want to commend you for your situational awareness, noticing the light bulbs missing and all. TP

Why do you think the perp didn't just break in while you guys were out? Do think there may have been some utterly evil reason he waited until you were home and in the bed?

If he intentionally wanted to break in with you guys in the house, I think that would be plenty justification for deadly force.
