Wrong Time to Take a Shot - Allegany County
PRESS RELEASE FROM ENVIRONMENTAL CONSERVATION:

On the morning of May 3rd, a New York State Trooper was travelling behind a pickup truck in the town of Grove when the truck suddenly stopped in the middle of the road. Much to the Trooper's disbelief, the operator of the truck pointed a gun out the window and fired two rounds at a turkey approximately 10 yards off the road. Both shots missed and the turkey flew away unharmed. The Trooper pulled the truck over. ECO RJ Ward responded to assist. After interviewing the shooter, ECO Ward charged the subject with possession of a loaded firearm in a motor vehicle, discharging a firearm from a public highway, illegally attempting to kill a turkey, attempting to take wildlife from a public highway, and attempting to take wildlife from a motor vehicle.

So what does that mean? Will he get life in prison for shooting at a damn bird?

New York State values are so messed up. Punishment should fit the crime, so give the guy a ticket for $100 or something for hunting from a road.

Sounds like they will destroy the guy.

I've been watching Lone Star Law and North Woods Law on the Animal Planet channel

Both are Game Warden shows, it's surprising what people will do and some of the excuses they come up with

At the end of the show, they'll usually say, who got fined what!

I really like the shows, they might actually help some as to "what not to do"

That's true in a lot of ways. Thing is though, there isn't any state where the dude could have done that and not got into major trouble.

Turkeys are usually covered by state laws.

Federal laws mostly apply to migratory birds that move from state to state or even to other countries.

The shooter should be fined heavily for firing from the road and not having permission to hunt the property.

Yes, but he was charged with 5 violations for taking 1 shot at a bird... and missing.

"After interviewing the shooter, ECO Ward charged the subject with possession of a loaded firearm in a motor vehicle, discharging a firearm from a public highway, illegally attempting to kill a turkey, attempting to take wildlife from a public highway, and attempting to take wildlife from a motor vehicle."

Most states would have likely not thrown the book at the guy.

Shooter probably acted like an A-hole so the Trooper threw the book at him.
The Judge will drop most charges and fine him a few hundred bucks.

Who stops in the road, in front of someone, and shoots their gun? This guy is a special kind of stupid.

Hey, turkeys are just people with feathers. We are all children of Mother Earth.

Yep. The guy should at least qualify for the Darwin Award.

Great handle, spacemanspiff. Calvin & Hobbes was my favorite cartoon.

I guess he could have charged him with littering, turkey terrorism, violating the noise ordinance, loitering, stalking, discharging lead into the environment and offensive body odor.

Gotta disagree. Most states hunting laws will bring the hammer down on activity like this. Probably won't get any jail time, but there will likely be fines and there's a pretty good chance the guy will lose hunting privileges for a while, if not indefinitely.

Shooting from the public right-of-way (a road) is a big no-no here.

And all 5 were violations that would have been basically the same regardless of the state. I'm not sure why you emphasized the missing part. Was that to point out that he was a poor shot in addition to being an idiot?

Yes, they would. Or at least all the ones that I've had any personal knowledge of, which is more than a few in a wide variety of regions of the country. The dude was a complete moron (which isn't illegal in itself and is quite common) but he broke a whole list of extremely common, logical game and public safety laws because of it.

Sorry to those who find this disagreeable, but I hate poachers. This guy was too stupid to even look in his rear view mirror before doing it, I hope they threw the book at him. Some places that had more turkeys than you could count now have none. Making you get a license for them helps keep populations healthy, and nobody should be shooting out the window of their truck. I hope he ruined his ear drums.

Good.

Poaching is a ridiculous thing, and shooting on the road is dangerous. EVERY state I have ever lived in would charge this guy with everything they mentioned, and more, he'd lose his gun(s)and his hunting privileges for a few years, plus pay a fine.

Don't like it? Too bad. Learn how to act in public with a gun, follow the freaking law, and there is no problem.

Yes, he did a bad thing.
But the taxpayers should not pay for 10 years of prison to punish the guy.

Rarely will a guy get any prison time for being that stupid, but he will pay out the ass in fines.
