Default Today I had my firearm seized.

Advertise Here

Today I had three DOJ special agents come to my house about a AR-15 that I had registered over a year ago under a new California Law.

I have owned this AR- 15 for 5 years and if was purchased through a FFL dealer. I registered it last June as required under a new CA Law. I have confirmation emails showing my transaction was completed and fees were paid...

The agents asked to inspect the firearm and make sure it matched the registration application.(This is where I F**ked Up)

After looking over the firearm, the agent in charge informed me that my registration application was filled out “incorrectly” making it void. My firearm matched the application, but something wasn’t completed.

He said my firearm was now considered illegal since it wasn’t registered by the cut off date.

They then gave me the option of voluntary handing it over or they would take it by force.

This all I’m going to post, I voluntarily handed it over as my wife and little kids cried(because mom was crying)

It’s starting, we are moving out of California.

It happened so fast and was the last thing I expected to happen. I have perfect record and do everything on the up and up.

What was the incorrect item in question? A falsehood on the question form?

Your statement above was on the cryptic side.

Why did you let them in your house?

Was there a search warrant?

It is called implied consent....... No, no thank you, you do not have my permission.

All my inputted information was correct, they claimed it wasn’t completed correctly. Like when you press submit and it shows you in red something needs to be completed.

But I have confirmation emails saying transaction completed and receipts for my fees being paid.

They asked if they could inspect the firearm, I said yes and they came in. (This is where I f**ked up)

The last thing I expected was to have the firearm seized

Haven't you heard? You don't have to worry cause no one is going to come and TAKE your guns away. Of course I've read numerous accounts about people getting their guns taken away for some minor error that was no fault of their own.

If they were there to say paperwork wasnt right, and to seize a firearm, I doubt you could have stopped them at the door.

I think they showed up there to get a gun no matter what you said or did.

I moved to California in 1982. I owned many guns incluuding an AR produced by Daewoo, that featured a folding stock.
When Ca started passing gun bans, feature descriptions, and magazine limits, i moved my AR out of state.

When i retired in 2014, I sold the house, and moved.
North east oklahoma holds the worlds buggest gun show twice a year, a full auto shoot in June, and a gun museum that covers a city block.

Have you considered contacting the NRA?
Or these folks: https://www.gunownersca.com

If the circumstances are as you describe,
(the missing information wasn't that you are a felon??)
seems like their lawyers would like to review this...
before a precedent is set and CA prosecutors get emboldened.

LEO will bend, negotiate, and plea bargain with pond scum.
But a law abiding family man who messes up on paperwork?

Surely, there should be an option to resubmit the paperwork,
pay a processing fee, and then come-on-down and pick her up.
Or, give the owner an opportunity through a CA dealer to sell
the weapon out-of-state.
Or break the gun down and he gets to retain the legal bits.
Otherwise, they just stole $500+ out of this guys wallet.

That is terrible OP. You're not to blame, it's the darn tyranny of California. Hope you get your gun back and get the heck out of CA.

Sorry to hear.
I would't be surprised if they are monitoring sites like this and using it to abuse the Constitution.

Contact the NRA first, they are best to direct you to the right local lawyer to help you.

Is there an appeal process or does the Gestapo just get to take you guns, no questions asked?

Are you sure they were DOJ agents? Did you get their ID numbers?

Did they give you a receipt for the confiscated gun?

What specifically did they say was wrong with the form you filled out?

We've had incidents in Arizona with guys posing as insurance inspectors who ask for access to your home to do a free assessment on behalf of your insurance company. They know who your insurance company is and have other info about you that makes them appear to be legit. Thus far, I don't know anyone foolish enough to let them in. The insurance companies have confirmed that they do not send inspectors to a home.

I just hope you were not the victim of a scam.

This is probably why the registration rate here is under 20%.
Letting them know where the guns are might be obeying the law but it remains unconstitutional.

you should not have complied in the first place, hate to say it. This is California's goal anyways...you could have answered every question golden and they would still have come. They are going to do this to almost all the registered people. Wow, like this board always "guessed" registration really will lead to confiscation. But, this is good learning for all of us from other states on why not to comply. Some will get in trouble, but the majority will keep their guns until it's not mandatory anymore to register them. imo

Is it bad that my first thought is " This thread is to see who all responds, I didn't / haven't/ won't/ etc register my guns as a ploy". Years on this site has turned me into a conspiracy theorist lol.

I am the only one I know that complied and registered my AR.

I’m clean cut, and follow the rules, plus I wanted to have an AR I can take to the range/desert, and not be worried about it.
