Didnt Laura Loomer just lose a trail against the tech giants? The court ruled the first amendment only applied to government control of speech .

Surely the conservatives with the heaps entrepreneurial types and thought leaders amongst them would have created a very successful mass communication platform by now!

If you dig a bit and look you'll find that there's government money backing (at some point) everything from Amazon to Facebook.

Hard to compete with the guys who print the money.

If they can raise 25 million to build a couple of hundred meters of wall I don’t think a whip round for a Safe Space social media platform for conservatives is a huge challenge.
Or maybe conservatives just want someone else to build it then they move in and dictate the rules. It’s almost Cuckoo bird behavior.

It's not a First Amendment issue, its a defamation issue. Under current law, platforms can't be sued for defamation based upon posts by users. Once the platform exercises editorial control over the content on its site, it becomes a publisher and loses its platform immunity.

Gossip deviates from the truth and generally only serves to hurt people

We can barely get facts out of the news, generally it's liberal gossip


It deserves no protection

Twitter, Facebook and others are in essence, monopolistic utilities. As such, censorship is illegal. Could you imagine the phone company blocking out your "inappropriate" words as you talk?

Easier way to combat it would be to relax the slander/libel burdens of proof and do something about willfully putting out false information without a disclaimer.

People, and the media in general, go nuts because they are untouchable. The burden of proof for a celeb (politician, athlete, etc) are nearly unreachable so people just say whatever the hell they want.

While they are an individual company and can do, for the most part, whatever they please on their own platform.


BUT you are not a platform if you are editing, censoring, banning, shadow banning, or hiding peoples content. You are now a publisher.
Publishers are responsible for making sure ALL content is filtered if they start doing some of it.

Facebook and others have recently tried to skirt that distinction by hiring "experts" and other quasi-third-party "fact-checkers," so as to make it seem that they are merely a platform for discussion and that there is some sort of allegedly-disinterested other entity doing the editorial work.


But this will only appease the Court of Public Opinion, and only for so long. There is a simple legal principle called agency, whereby the party who employs a malefactor takes responsibility for their actions, just the same as a restaurant would be liable if one of their disgruntled employees pooped in your sandwich.

What I find weird is executive agreements are only directives to the operations of the federal government, they don't extend in to the private sector. The constitution is the same, it's only a limit on government, not private business. It's how private school can teach religion or why paid security companies don't have to respect to global treaties. I can be removed from a restaurant for talking too loud, but I can't be denied due process because I yell when I talk.
